Terms & Conditions
1. Introduction
These Terms & Conditions (“Terms”) govern the use of this website and the purchase of products from Amerelia Ltd (“we”, “us”, “our”). By placing an order, you confirm that you have read and agree to these Terms and all applicable laws of the Republic of Cyprus and the European Union.
Amerelia Ltd is a company registered in Cyprus. Our business details are stated above. For any queries, contact us at support@amerelialtd.com.
2. Products
We sell perfumes and related personal care products. All product descriptions, images, and specifications are presented as accurately as possible. Minor variations in colour or appearance may occur due to photography or screen settings.
All products are genuine and sourced from authorised suppliers. Products are sold as consumer goods and are not intended for resale or commercial use unless otherwise agreed in writing.
3. Orders & Payments
- Orders are confirmed only when payment is successfully completed and you receive an order confirmation email.
- Payments are processed securely via JCC Payment Systems. We do not store your card details.
- At checkout, you will be required to acknowledge that your order involves an obligation to pay by confirming via a clearly labelled button.
- We reserve the right to cancel or refuse any order at our discretion, including in cases of pricing errors, stock issues, or suspected fraud. In such cases, any payment taken will be refunded in full.
- A durable order confirmation (email) will be sent to you within a reasonable time after the contract is concluded.
4. Delivery (ACS Pickup)
- All orders are delivered to your selected ACS Courier pickup point. We do not offer home delivery.
- Estimated delivery: approximately 5 working days from order confirmation.
- You will be notified when your parcel is ready for collection at your chosen ACS point.
- Customers must collect their order within 5 working days of the collection notification. After this period, uncollected parcels may be returned to us by ACS.
- Delivery timelines are estimates and may be affected by courier delays or circumstances beyond our control. We are not liable for delays caused by ACS Courier.
5. Right of Withdrawal (EU Law)
5.1 How to Exercise Withdrawal
To exercise your right of withdrawal, you must notify us of your decision by:
- Sending an email to support@amerelialtd.com with your name, order number, and a clear statement that you wish to withdraw; or
- Using the model withdrawal form below.
The withdrawal period is met if you send your notification before the 14-day period expires.

5.2 Exceptions to the Right of Withdrawal
In accordance with Article 16(e) of Directive 2011/83/EU, the right of withdrawal does not apply to:
- Perfumes or other personal care products that have been unsealed after delivery, where the goods are not suitable for return due to health protection or hygiene reasons.
If you open the product seal, you lose your right of withdrawal for that product. This is a legal exception and is not a company restriction.
6. Returns & Refunds
6.1 General Return Conditions
Returns must be requested within 14 days of receiving your order. Products must be returned in the same condition as received. Return shipping costs are borne by the customer, unless the product is defective or incorrectly sent.
6.2 Fully Unopened Products (Outer & Inner Packaging Intact)
If both the outer shipping packaging and the product seal are completely unopened and intact, you are eligible for a full refund of the purchase price and original delivery charge.
6.3 Opened Outer Packaging – Product Seal Intact
If the outer shipping/retail packaging has been opened but the product’s original hygiene seal remains fully intact and unbroken:
- The return may be accepted at our discretion after inspection.
- If accepted, a refund will be issued minus the return shipping cost (€2.00), which represents the cost to return the item via ACS Courier.
- This deduction is not the same as your original delivery charge, which is refunded separately.
Note: If you believe the outer packaging was damaged in transit, please notify us with photo evidence within 48 hours of collection.
6.4 Opened Product Seal (Hygiene Exception)
Once a perfume or personal care product’s seal has been broken or removed after delivery, the product cannot be returned or refunded. This is a mandatory exception under EU law (Article 16(e), Directive 2011/83/EU) due to health protection and hygiene reasons. This applies regardless of whether the product has been used.
7. Failed Collection
- If an order is not collected from the ACS pickup point within the collection window, ACS will return the parcel to us.
- We will contact you when a parcel is returned.
- If the goods are in a returnable condition (sealed), we will issue a refund of the product price minus any return shipping costs incurred.
- If the goods have been opened in transit or are otherwise not returnable (e.g. hygiene seal broken), no refund will be issued.
- We are not liable for parcels that cannot be re-delivered due to incorrect pickup point selection by the customer.
8. Damaged or Incorrect Orders
- If your order arrives damaged or you receive the wrong product, you must notify us within 48 hours of collection at support@amerelialtd.com.
- You must provide clear photo evidence of the damage or incorrect item before any remedy is offered.
- After verification, we will offer either a full replacement or a full refund at our discretion. Return shipping costs for damaged or incorrect items are covered by us.
- This is separate from and in addition to your rights under the EU 2-year legal guarantee (Section 9).
9. EU 2-Year Legal Guarantee
Under EU Directive 2019/771 on the sale of goods, all products sold are covered by a statutory 2-year legal conformity guarantee from the date of delivery. If a product is not in conformity with the contract at the time of delivery (e.g. defective, incorrectly described), you are entitled to:
- Repair or replacement of the product; or
- A price reduction or full refund if repair/replacement is not possible.
This guarantee does not affect your statutory right of withdrawal and applies regardless of any commercial warranty we may offer.
10. Refund Processing
- Refunds are issued to your original payment method only.
- Under EU law, refunds must be issued within 14 days of receiving your withdrawal request (and, where applicable, of receiving the returned goods).
- In practice, we aim to process refunds within 3–7 business days. Processing time may vary depending on JCC and your card issuer.
- We will not impose any fee for the refund itself.
11. Limitation of Liability
To the maximum extent permitted by law, Amerelia Ltd shall not be liable for:
- Indirect, incidental, or consequential damages arising from the use of our website or products;
- Delays caused by ACS Courier or JCC Payment Systems;
- Losses arising from incorrect information provided by the customer (e.g. wrong pickup point).
Nothing in these Terms limits your statutory rights under EU or Cyprus consumer law, including your rights under the EU Consumer Rights Directive 2011/83/EU, the Sale of Goods Directive 2019/771, or any other applicable law. Our liability for death or personal injury caused by negligence, or for fraudulent misrepresentation, is not excluded.
12. Disputes & Alternative Resolution
If you have a complaint or dispute, please contact us first at support@amerelialtd.com. We aim to resolve all disputes within 14 business days.
As required by EU Regulation No. 524/2013, we are required to inform you that the European Commission has established an Online Dispute Resolution (ODR) platform for resolving disputes between consumers and traders in the EU. You can access it at: https://ec.europa.eu/consumers/odr.
You may also contact the Cyprus Consumer Protection Service or the relevant Cyprus courts.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus and applicable EU law. Any dispute not resolved amicably shall be subject to the exclusive jurisdiction of the Cyprus courts, without prejudice to any mandatory consumer protection rights you hold under the laws of your country of residence.
